Abstract: | Ethnic discrimination is not a matter of the past, continues to be present not only in practice but also in the discourses. Generally it is thought that the laws are fair and non-discriminatory, such as the fundamental principles of human rights. However here it is argued that these laws are made by dominant groups, it is possible to identify racist and multiculturalist discourses, despite the recognition of interculturality in the multiethnic and multicultural countries. This paper presents an aproximation to the critical analysis of the legal framework of the right to health in Mexico, focused specifically on indigenous peoples. La discriminación étnica no es cuestión del pasado, sigue presente no sólo en las prácticas, sino también en los discursos. Generalmente se piensa que las leyes son justas y no discriminatorias, como los principios fundamentales de los derechos humanos; sin embargo al ser diseñadas por los grupos dominantes, es posible identificar discursos racistas y multiculturalistas, a pesar del reconocimiento de la interculturalidad en los países pluriétnicos y multiculturales. En este trabajo se presenta una aproximación al análisis crítico del marco legal del derecho a la salud en México, enfocado específicamente a los pueblos indígenas. |
