Abstract: Notwithstanding the significant constitutional progress made in the recognition of the Rights of Hearings and their solid legal foundation by the Mexican State, paradoxically private concessionaires of commercial electronic media argued that such guarantees were legally unfair and negative because they violated freedom of expression, freedom of information, freedom of enterprise, introduced censorship, prevented the proper transmission of news on a daily basis, etc. Derived from these strong media pressures, the Executive Branch and the Legislative Branch renounced the constitutional commitment to recognize the rights of the audiences and presented some constitutional controversies to annul such guarantees. Therefore, guarantees of the audiences recognized at the heart of the Mexican Political Constitution after many decades; were annulled to favor the economic, political and cultural interests of television oligopolies in Mexico. Pese a los relevantes progresos constitucionales alcanzados en materia de reconocimiento de los derechos de las audiencias y de su sólida fundamentación jurídica por parte del Estado mexicano, paradójicamente los concesionarios privados de los medios electrónicos comerciales argumentaron que tales garantías eran legalmente improcedentes y negativas, pues atentaban contra la libertad de expresión, la libertad de información, la libertad de empresa, introducían la censura, impedían la adecuada transmisión cotidiana de las noticias, etcétera. Derivado de estas fuertes presiones mediáticas, el Poder Ejecutivo y el Poder Legislativo renunciaron al compromiso constitucional de reconocer los derechos de las audiencias y presentaron diversas controversias constitucionales para anular tales garantías. De esta forma, mediante la aprobación de dicha contrarreforma comunicativa se ejerció una fuerte violencia jurídico-política de Estado hacia las audiencias, permitiendo que garantías comunicativas fundamentales de los receptores reconocidas expresamente en el corazón de la Constitución Política mexicana después de muchas décadas, fueran anuladas para favorecer los intereses económicos, políticos y culturales de los oligopolios de la televisión en México.
